1. Definitions
In these Terms and Conditions, the following terms carry the meanings set out below:
- "Kukuh Capital" / "We" / "Us" / "Our": Kukuh Capital, a financial education provider registered and operating in Malaysia.
- "Participant" / "You" / "Your": Any person who enrols in, enquires about, or uses the services or website of Kukuh Capital.
- "Programme" / "Service": Any financial education session, course, or programme offered by Kukuh Capital, including those listed on this website.
- "Website": The Kukuh Capital website accessible at https://kukuhcapita.
- "Content": All materials, workbooks, notes, frameworks, and resources provided as part of any Programme.
- "Agreement": The contract formed when you enrol in a Programme, governed by these Terms and Conditions.
2. Acceptance of Terms
By submitting an enquiry form, making a payment, or attending any session, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions.
You must be at least 18 years of age and have the legal capacity to enter into a binding agreement in Malaysia to use our services.
If you do not agree to these Terms, please do not proceed with an enquiry or enrolment.
3. Service Description
Kukuh Capital offers financial education programmes designed for Malaysians aged 40 and above. Our current programmes include:
Post-Retrenchment Financial Triage Session
Two-session engagement covering financial stabilisation, cash flow, EPF considerations, and severance navigation. Includes a financial triage action plan. Fee: RM 650.
Mutual Fund Selection Education Course
Four-session course on evaluating unit trust funds in Malaysia, covering ratings, fees, and building a personal selection framework. Includes a fund evaluation workbook. Fee: RM 1,650.
Dignified Ageing Financial Programme
Seven-session programme on healthcare funding, long-term care, home planning, and maintaining financial autonomy. Includes a dignified ageing plan and quarterly consultations for one year. Fee: RM 3,380.
All programmes are educational in nature. They do not constitute financial advice, investment recommendations, or regulated financial planning services under Malaysian law.
4. Enrolment and Booking
Enrolment is confirmed upon receipt of full payment (or agreed deposit where applicable) and written confirmation from Kukuh Capital. Session scheduling is arranged directly with our team following confirmation.
We reserve the right to decline or cancel an enrolment at our discretion, in which case any fees received will be refunded in full.
Programme availability is subject to facilitator scheduling and capacity. We will endeavour to accommodate preferred session times where possible.
5. Payment Terms
- All fees are quoted in Malaysian Ringgit (RM) and are inclusive of applicable taxes unless stated otherwise.
- Payment is due prior to the commencement of sessions unless an alternative arrangement has been agreed in writing.
- Accepted payment methods include bank transfer and other methods communicated at the time of booking.
- Receipts will be issued upon payment confirmation.
- Fees are non-transferable to another participant without prior written consent from Kukuh Capital.
6. Cancellation, Rescheduling, and Refunds
Participant-initiated cancellations:
- Cancellations made 7 or more calendar days before the first session: full refund of fees paid, less any administrative processing costs.
- Cancellations made fewer than 7 days before the first session: 50% of the programme fee is retained as a scheduling and preparation fee.
- No refund will be issued for cancellations made after the first session has commenced.
Rescheduling:
We understand that life circumstances change. You may request one rescheduling of your programme at no charge, subject to availability and reasonable notice of at least 48 hours.
Kukuh Capital-initiated changes:
In the unlikely event that we need to cancel or significantly reschedule a session, we will provide as much notice as possible and offer an alternative time or a full refund.
7. Participant Responsibilities
To get the most from our programmes and to maintain a respectful learning environment, participants agree to:
- Attend sessions punctually and engage in good faith.
- Treat facilitators and fellow participants with courtesy and respect.
- Not record sessions (audio or video) without prior written consent from Kukuh Capital.
- Use programme materials solely for personal, non-commercial education.
- Not share, reproduce, or distribute workbooks or session materials to third parties.
- Provide accurate personal information at the time of enrolment.
8. Intellectual Property
All content delivered through Kukuh Capital programmes — including session frameworks, workbooks, methodologies, and written materials — remains the intellectual property of Kukuh Capital.
Upon enrolment, participants are granted a personal, non-exclusive, non-transferable licence to use programme materials for their own financial education purposes only.
Commercial use, redistribution, reproduction for teaching, or adaptation of our materials for any purpose other than personal use is expressly prohibited without prior written consent.
9. Educational Nature of Services
Kukuh Capital is an education provider, not a licensed financial adviser, fund manager, or insurance agent. Our programmes provide knowledge and frameworks to help you make more informed decisions.
Nothing in our programmes, materials, or communications constitutes financial advice, investment advice, or any form of regulated financial service under the Capital Markets and Services Act 2007, the Financial Services Act 2013, or any other Malaysian legislation.
For personalised financial advice, we encourage participants to consult a licensed financial planner registered with the Securities Commission Malaysia or Bank Negara Malaysia.
10. Limitation of Liability
To the fullest extent permitted by Malaysian law, Kukuh Capital's liability in connection with any Programme or use of this website shall be limited to the amount of fees paid by you for the specific programme in question.
We shall not be liable for any indirect, incidental, consequential, or special losses, including but not limited to investment losses, opportunity costs, or losses arising from reliance on programme content without independent professional advice.
Nothing in these Terms limits liability for fraud, personal injury caused by our negligence, or any liability that cannot lawfully be excluded under Malaysian law.
11. Confidentiality
We understand that participants may share personal financial circumstances during sessions. Kukuh Capital treats all such disclosures with strict confidentiality and will not share personal details discussed in sessions with any third party, except where required by law.
Participants are similarly asked to respect the confidentiality of any information shared by other participants in group or workshop settings.
12. Website Use
You may use this website for lawful purposes only. You agree not to:
- Attempt to gain unauthorised access to any part of this website or its systems.
- Use automated tools to scrape, copy, or harvest content from this website.
- Post or transmit any content that is unlawful, harmful, or misleading.
- Misrepresent your identity or affiliation when making enquiries.
13. Termination
Either party may terminate participation in a programme with written notice. Refund entitlements in such cases are governed by Section 6 above.
Kukuh Capital reserves the right to terminate a participant's access to a programme without refund in cases of serious misconduct, breach of these Terms, or behaviour that disrupts the learning environment for others.
14. Governing Law and Dispute Resolution
These Terms and Conditions are governed by and construed in accordance with the laws of Malaysia. Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Malaysia.
Before initiating formal legal proceedings, we encourage participants to contact us directly to resolve concerns informally. Most matters can be addressed through open and respectful communication.
You may also have rights under the Consumer Protection Act 1999 of Malaysia, which these Terms do not seek to limit.
15. General Provisions
- Entire Agreement: These Terms, together with any written enrolment confirmation, constitute the entire agreement between you and Kukuh Capital.
- Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force and effect.
- Waiver: Failure by Kukuh Capital to enforce any provision does not constitute a waiver of that provision.
- Assignment: You may not assign your rights under these Terms without our prior written consent. We may assign our obligations to an appropriately qualified successor.
- Notices: Formal notices should be sent to us in writing at the contact details provided below.
16. Changes to These Terms
We may update these Terms and Conditions from time to time to reflect changes in our services, applicable law, or best practices. The revised version will be published on this page with an updated "Last Updated" date.
For participants currently enrolled in a programme, material changes to these Terms will be communicated in writing prior to taking effect.
